The National Association of Realtors has thrown its weight behind a new proposal from the U.S. Department of Labor aimed at clearing up the rules around independent contractor status. Industry leaders say the move would bring much-needed clarity to real estate professionals who operate as small business owners.
In a formal comment letter, NAR officials argued that the current patchwork of state and federal guidelines often creates confusion for agents and brokers. The proposed rule, they noted, would establish a more consistent framework for determining whether a worker qualifies as an independent contractor or an employee under the Fair Labor Standards Act.
Real estate agents have long relied on independent contractor status, which gives them flexibility in managing their schedules and business operations. But legal challenges and shifting interpretations of the law have made compliance difficult. NAR's support signals that the industry wants a clear, pragmatic standard that reduces legal risk without overburdening small firms.
The association emphasized that the proposal should preserve the entrepreneurial nature of real estate work while ensuring proper protections for workers. By backing the Labor Department's effort, NAR is pushing for regulations that reflect how the modern real estate industry actually functions, rather than forcing outdated employment models onto a workforce that values independence.
